Childhood bullying is not a rite of passage, it is not innocent child’s play, and it is not acceptable. Bullying not only hurts feelings, it can also cause serious injuries, including death.
Both Physical and Verbal Bullying Can Give Rise to Wrongful Death Lawsuits
- Physical Bullying. If the bully commits a battery on the victim and the physical injuries result in death then the victim’s family may have a wrongful death lawsuit.
- Verbal Bullying. If the bully commits an assault or inflicts emotional distress on the victim which result in death then the victim’s family may have a wrongful death lawsuit.
Identifying the Proper Defendants in a Bullying Wrongful Death Case
The actual bully may be one defendant in a wrongful death lawsuit. Additionally, the adults responsible for supervising that child may also be responsible. For example, if the bullying situation was known, or should have been known, to the school officials or parents and the school or parents failed to take appropriate actions then the school or parents could be liable.
