With Thanksgiving behind us, it seems that winter has begun. While many in the Northeast experienced an unusually early and dangerous first snowfall around Halloween, we know that many dangers of winter weather are still ahead of us.

As we head into the winter season, we encourage you to avoid winter wrongful death accidents by:

Using Extreme Caution on Icy or Snowy Roads. A fatal car collision can occur when the roads are difficult to manage.

Being Aware of Carbon Monoxide Risks. Cars that are warming up, heaters and grills used indoors can all create a silent but deadly risk of carbon monoxide poisoning.

Watching for Downed Power Lines. The weight of snow or falling trees can cause live wires to fall and they may be hard to see in the often dark hours of winter days and nights.

Have you lost a loved one in a winter accident? Do you have any additional safety tips that would like to provide for others? If so, please leave a comment and share your thoughts so that others may avoid potentially tragic situations.

An accident is an accident. The pain and loss of a fatal accident does not change depending on where it occurred. However, the state laws concerning a potential recovery do vary.

For that reason, it is important to contact a wrongful death lawyer in the state in which the accident occurred for advice. An accidental death attorney who practices in that state will be able to advise you about things such as how long you have to file a claim and what your potential recovery may be.

Do not take chances with your potential recovery. Instead find out the facts about your recovery so that you can make informed decisions about your potential wrongful death claim.

This month marked the 10th anniversary of the September 11 attacks. It was a meaningful, somber, and reflective time for many Americans, but most especially for the families directly affected by the terrorist attacks. For the family of Mark Bavis, this month also marked the settlement of their wrongful death case against United Airlines and its security company.

The terms of the wrongful death settlement have not been disclosed. It is believed to be the last wrongful death case pending from the September 11 attacks.

We extend our sincerest condolences to the Bavis family and to all the friends and relatives of September 11 victims.

In a literal way, all accidents may be wrongful deaths. However, not all accidents are wrongful deaths according to the legal definition of wrongful death. While each state defines wrongful death in its own way, there are common elements to wrongful death cases.

Generally, a legal wrongful death is one which occurred because of someone else’s negligence or intentional actions. Whether the death occurred as a result of a car accident, medical malpractice, a workplace accident or any other cause, the plaintiff must still prove that the death occurred because of negligence or an intentional act.

If you have any concern about whether your loved one’s death was due to negligence or an intentional act, then I encourage you to contact a wrongful death lawyer to learn more about your legal rights and potential recovery.

The last thing that you want to think about when you are unexpectedly grieving the loss of a loved one is the cost of a funeral, yet funerals are expensive.
